Terms of Service

1. Acceptance of Terms

By using KKTCar services ("Platform"), you agree to these terms of service. The Platform includes the KKTCar website, mobile application, and all related digital services. If you do not agree to these terms, please do not use the Platform.

2. Account Creation

You may need to create an account to use the Platform. You are responsible for providing accurate, complete, and up-to-date information for your account. You are responsible for the security of your account and all actions performed under your account.

3. User Content

You are responsible for all content you share through the Platform (listings, comments, photos, etc.). Please ensure that the content you share is legal and appropriate.

KKTCar reserves the right to remove or reject any user content at any time without prior notice. This is especially applicable for content that violates the terms of service, is illegal, misleading, or harmful to other users.

4. Prohibited Conduct

The following behaviors are strictly prohibited in Platform usage:

• Sharing illegal, harmful, threatening, harassing, defamatory, or obscene content.
• Impersonating another person or organization (identity fraud).
• Sharing content that infringes copyright, trademark, or other intellectual property rights.
• Uploading or transmitting viruses, malware, or other harmful code.
• Interfering with or disrupting the normal operation of the Platform.
• Using the Platform for commercial purposes (without prior permission).

5. Content Rights

You represent and warrant that you own the rights to the content you share through the Platform or have the necessary permissions to share the content. At the same time, you grant KKTCar the right to use this content for providing and improving Platform services.

6. Account Suspension and Termination

KKTCar reserves the right, at its sole discretion, to temporarily suspend or permanently terminate any account without prior notice. Reasons for suspension or termination may include:

• Violation of these terms of service.
• Engaging in illegal activities.
• Exhibiting inappropriate or harmful behavior.
• Prolonged inactivity.
• Other reasons at KKTCar's discretion.

7. Listing Publication Rules

When publishing listings, you must comply with the following rules:

• Listing content must be accurate and complete.
• Photos must be genuine and accurately represent the relevant product/service.
• Illegal products or services must not be listed.
• Price and other information must be accurate.

KKTCar reserves the right to remove or modify any listing without prior notice.

8. Premium Services and Purchases

KKTCar offers paid services — including 'premium' (featured) and 'urgent' features — to increase the visibility of listings. These can be purchased either through in-app purchases in the mobile application or by card payment on the website. The following terms apply to these services:

• In the mobile application, premium and urgent services are acquired through in-app purchases and charged to your App Store/Google Play account.
• The duration of a purchased premium or urgent feature is as specified (e.g., 7 days), is a one-time purchase, and does not automatically renew.
• Refunds for premium purchases are subject to the policies of the relevant store (Apple App Store or Google Play Store) and are managed directly through these platforms. For payments made on the website, refunds are governed by the Refund Policy section below.
• KKTCar reserves the right to offer alternative solutions or extend the duration for users if premium services cannot be provided due to technical reasons.
• The availability of premium services depends on the current quota status within the application (maximum 20 premium listings).
• On the website, payments are processed by our third-party payment processor, Stripe, and charged to the card or payment method you provide. KKTCar does not receive or store your full card details. Premium and urgent services can only be purchased for listings that are approved and active. If a payment is taken for an ineligible listing (for example, one that is not approved, has been deleted, or already has an active boost), KKTCar will refund that payment.

9. Content Ownership and Usage Rights

With respect to all content shared or uploaded on the KKTCar platform (including listing photos, descriptions and vehicle information), users represent that they own the content or have the right to share it. While retaining ownership of their content, users grant KKTCar a worldwide, royalty-free, perpetual, irrevocable, transferable and sublicensable license to use that content, including the right to edit, crop, adapt and combine it with other works. The rights granted under this license include:

• The right to use photos and content shared by users in KKTCar's marketing and promotional activities, social media accounts, advertising work, and on the application/website.
• The right to use listing content and photos for platform improvement, research, and development purposes.
• The right to classify, organize, and process content within the platform to improve user experience.

These rights survive even if the user leaves the Platform or closes their account. KKTCar may share or sublicense this content (including listing photos and descriptions) with its business partners, advertising networks and service providers. The processing of your account and personal data is separately governed by our Privacy Policy.

10. Account Suspension and Content Removal

KKTCar reserves the right to suspend, terminate user accounts, or remove content without any prior notice in the following cases:

• If the terms of service are violated in any way.
• If misleading, false, fake, or inappropriate content is shared on the Platform.
• If there is harassment, threats, or inappropriate behavior toward other users.
• If activities that would interfere with the normal operation of the Platform or damage the system are conducted.
• If misleading information is provided in listings or fake products/services are offered.
• If the account is not used or inactive for an extended period.

When a user's account is suspended or terminated, the user cannot claim any refund, including for purchased premium services.

KKTCar has the right to remove, edit, or move any content or listing without prior notice for the purpose of platform security, maintaining service quality, or fulfilling legal obligations.

A listing being marked as 'premium', 'featured' or 'urgent', or published via a paid service, does not in any way limit KKTCar's right to remove, suspend, edit or reject that listing. No refund, credit or compensation may be claimed for premium, featured or urgent listings that are removed or suspended due to a breach of these Terms or at KKTCar's discretion.

11. Refund Policy and Dispute Resolution

Our refund policy for Premium and Urgent services purchased through the Platform is as follows:

• Refund processes for purchases made through the App Store/Google Play are subject to the policies of the respective stores. Refund requests must be made directly through the relevant store.
• After premium service is activated, no refund will be provided regardless of whether the service is used or not.
• If premium service cannot be provided due to technical errors or KKTCar's fault, KKTCar reserves the right to extend the service period, offer alternative service, or provide a refund.
• For purchases made on the website (processed by Stripe), refund requests should be made by contacting KKTCar at [email protected].
• If a payment is taken for an ineligible listing (for example, one that is not approved, has been deleted, or already has an active boost), the amount will be refunded to your original payment method.

Dispute Resolution: In any dispute arising from the use of KKTCar services, you must first try to resolve the issue amicably by contacting KKTCar. If a resolution cannot be reached this way, the courts of the Turkish Republic of Northern Cyprus (TRNC) will have jurisdiction in resolving disputes.

12. Force Majeure

KKTCar cannot be held responsible for service interruptions or delays caused by force majeure, including but not limited to natural disasters, war, terrorist attacks, riots, government restrictions, internet or server failures, interruptions by third-party service providers, and other events beyond its control.

In case of force majeure, KKTCar reserves the right to temporarily close the platform, suspend, or restrict services. In such cases, extending the duration of premium services is at KKTCar's discretion.

13. Disclaimer of Liability

The Platform is provided "AS IS" and "AS AVAILABLE". KKTCar does not guarantee that the platform will operate without interruption or error.

• KKTCar cannot be held responsible for any damages resulting from the use of the platform, including direct or indirect losses.

13.1. Intermediary Service and Limitation of Liability

KKTCar serves as an intermediary platform that facilitates communication between users. KKTCar is not a party to transactions made through the Platform or disputes between users and assumes no legal liability. All transactions conducted through our platform are the responsibility of the relevant parties.

KKTCar does not screen, verify or guarantee the accuracy, quality, safety, legality or authenticity of listings, users, vehicles or transactions. Users carry out all communications and transactions made through the Platform entirely at their own responsibility and risk. You agree to indemnify and hold KKTCar harmless against any claims, damages and costs arising from your use of the Platform or your breach of these Terms. KKTCar's total liability is in any case limited to the amount you paid to KKTCar in the preceding 12 months.

13.2. Exchange Rates and Price Information

The exchange rates displayed on the Platform are obtained from the Central Bank of the Republic of Turkey (TCMB) and other official sources. These rates may not be real-time and errors may occur during conversion. KKTCar cannot be held responsible for any errors or losses resulting from currency conversions. Users are responsible for verifying current rates from official sources.

14. Changes

KKTCar reserves the right to change these terms of service at any time. Changes will be notified through the Platform and will be effective from the date of change. Your continued use of the Platform after changes means you accept the updated terms.

16. AI Assistant (Otobot)

The Platform offers an AI chat assistant called 'Otobot'. Otobot's responses are generated automatically by third-party AI models and are provided for informational and convenience purposes only.

• Information, suggestions and price/valuation estimates provided by Otobot may be inaccurate, incomplete or out of date; they are approximate and are in no way a guarantee, commitment or definitive value.
• Otobot's output does not constitute professional, financial, legal, technical or expert advice.
• It is the user's responsibility to independently verify all information via the relevant listing page and with the seller before making any decision.
• KKTCar is not liable for any decisions made in reliance on Otobot's output or for any direct or indirect damages arising from it.
• Otobot may be used for vehicle and marketplace purposes only; attempting to manipulate the assistant (misleading prompts, automated scraping, abuse) is prohibited. KKTCar reserves the right to modify, limit or discontinue Otobot without prior notice.

Messages you share with Otobot are processed in accordance with our Privacy Policy and may be transferred to third-party AI providers for processing. Please do not enter sensitive personal information into the chat.
